In Turkey, types of enforcement proceedings vary depending on the subject of the claim and the basis of the claim. Enforcement proceedings are generally classified as follows:
1. Enforcement Proceedings Without a Judgment
- Enforcement proceedings specific to negotiable instruments: Initiated for the collection of debts based on cheques, promissory notes or bills of exchange.
- General attachment proceedings: Initiated for any debt not based on a document. Invoice receivables fall under this category.
2. Enforcement proceedings based on a court order
- Proceedings based on court decisions: Carried out for the enforcement of final court decisions.
- Proceedings for eviction and delivery: Initiated for the eviction of a tenant or the delivery of property.
3. Proceedings for the conversion of pledges into cash
- Proceedings for the conversion of movable pledges: Initiated for the conversion of pledges established on movable property into cash.
- Movable pledge enforcement proceedings: Includes the conversion of mortgaged immovable property into cash and the collection of receivables.
4. Bankruptcy proceedings
- Direct bankruptcy proceedings: The process of requesting the debtor to file for bankruptcy with the commercial court.
- General bankruptcy proceedings: The bankruptcy process initiated in the event of non-payment of debt.
5. Alimony Claim Proceedings
- Based on a court decision, these proceedings are aimed at collecting unpaid alimony claims.
